Loyalty One – End User License Agreement (EULA)

Introduction

This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and Yuvati (Pty) Ltd, the owner of the Loyalty One mobile application (“App”). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.

1. License

Yuvati grants you a limited, non-exclusive, non-transferable, revocable license to use the Loyalty One App solely for your personal, non-commercial use on a compatible device that you own or control.

2. Restrictions

You agree not to:
– Copy, modify, or distribute the App
– Reverse engineer, decompile, or disassemble any part of the App
– Use the App for any unlawful purpose or in violation of any applicable law
– Sell, lease, or sublicense the App to any third party

3. Ownership

All rights, title, and interest in the App, including all intellectual property rights, are and shall remain the exclusive property of Yuvati. This Agreement does not grant you any ownership interest in the App.

5. Subscriptions and Payments

The App may offer auto-renewable subscription services. All billing is handled through your App Store account and subject to the store’s billing policies. You are responsible for managing your subscriptions through your App Store account.

6. Termination

This Agreement is effective until terminated. It will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete it from your device.

7. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. Yuvati does not guarantee that the App will be error-free or uninterrupted.

8. Limitation of Liability

To the maximum extent permitted by law, Yuvati shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa.

10. Apple Terms

This Agreement is between you and Yuvati, not Apple Inc. Apple is not responsible for the App or its content. In the event of any conflict between this Agreement and the Apple Media Services Terms and Conditions (including the Apple Standard EULA), the Apple terms will govern.
